Why Chapter 13 May Be The Best Solution

While most people think Chapter 7 is the best bankruptcy option to eliminate their debts, it isn’t always the best option for many people and families.

Chapter 13 bankruptcy is a repayment plan. Chapter 13 cases typically last between three to five years and require you to pay back certain creditors in order of priority. One advantage of a Chapter 13 bankruptcy is that it can allow you to pay back your unsecured creditors (most credit cards, medical bills, loans without collateral) without losing any of your property, such as your house.

Depending on your situation, you may end up paying your unsecured creditors nothing, only a portion of what you owe them, or you may pay them back in full.  A bankruptcy judge must approve the Chapter 13 debt repayment plan proposed. Your monthly bankruptcy payment is based upon what you can afford and will go to pay off the debts specified in your approved repayment plan. Once your repayment plan has been paid, you will receive a discharge.
